I bought New Jersey Nets tickets from Vince on Craigslist because I was going to be in New Jersey in a week and a half on business. I paid him $25 in express shipping and waited for the tickets. Vince sent the tickets regular mail instead and so not only did I pay too much, I didn’t get the tickets in time and had to leave without them. Luckily, I had my neighbor check the mail and she sent the tickets to me in New Jersey. They arrived the day of the game. Unfortunately, it cost me $45 in postage to get them there overnight. I would like my postage costs refunded by Vince. It wasn’t right for him to send them regular mail when I paid express.

Vince's Testimony
I was sick the day I sent the tickets and I sent my wife to the post office. I think she made a mistake and sent another package I needed to mail that day express instead of the one I was trying to send to Tony. It was an honest mistake. I’m totally sorry but I don’t think it’s my fault!

Case Decision
Thanks for your speedy responses to my questions. I’ve taken time to deliberate and my decision is outlined below.
I believe that Vince, despite your admission of guilt and your apology, you made a deal with Tony to deliver the tickets to him on time and were negligent in living up to your end of the bargain. The issue of your wife sending the wrong package is something you need to take up with her.
With this being the case, please make restitution with Tony by refunding him the difference between express mail and regular mail and pay him back for the cost of couriering the tickets to New Jersey. You owe him a total of $69.
